TERMS & CONDITIONS  

1. Publication Frequency and Payment Terms | *Local Motion Magazine* is published on a monthly schedule. Advertising rates are listed per issue. Invoices will be issued within 24 hours of signing this agreement. Advertising space is securely held only upon receipt of a **50% non-refundable deposit**. The remaining 50% balance is due on or before the final artwork deadline date. **Ads will not be published or printed without full payment.** Late payments may result in the loss of ad placement or forfeiture of ad inclusion for the scheduled issue.

2. Ad Placement | While we welcome specific positioning requests, exact ad placement cannot be guaranteed. *Local Motion Magazine* is thoughtfully organized by business category to maintain editorial flow and visual consistency.

3. Contracts & Design Services | Advertisers who commit to 3-, 6-, or 12-month contracts receive complimentary initial ad design, which includes **up to two (2) complimentary rounds of revisions**. During the contract period, minor monthly updates (such as text edits or image swaps) are included at no extra charge. Additional revisions beyond two rounds will be billed at a rate of **$50 per hour** (1-hour minimum). Full ad redesigns during a contract term will incur a flat **$150 redesign fee** per instance.

4. Artwork Submission Guidelines | Advertisers may submit their own completed, production-ready artwork; however, submitting your own artwork does not reduce the advertising rate . All files must be submitted in **CMYK format as high-resolution (300 DPI) PDFs or JPGs**, adhering to the exact dimensions and bleed requirements outlined in our ad size chart. Artwork submitted incorrectly—whether due to sizing, low resolution, or missing bleed—will not be printed. If compliant artwork is not provided by the deadline, or if the advertiser fails to approve a team-designed proof in time, **the ad space will still be billed as scheduled.** 

5. Editorial Use of AI Tools | *Local Motion Magazine* may utilize AI-assisted tools for article drafting and editorial content development. However, all graphic design work, including advertisements and layouts, is completed entirely by human designers.

6. Liability, Color Variance, & Good Faith Policy | The publisher assumes no liability for errors or omissions in advertiser-supplied materials. While our design team takes great care, human error can occur (e.g., typos, incorrect images, or layout inconsistencies). We rely on the advertiser to thoroughly review all proofs.  **Standard Liability:** Approval of the final proof serves as final confirmation that all information is correct and releases *Local Motion Magazine* from liability for errors caught after printing. Furthermore, due to inherent variations in print processes and paper stock, colors may appear slightly different in print than on screen. We cannot guarantee exact color matching, and no refunds or discounts will be issued for minor, standard color shifts. **Our Good Faith Promise (Publisher-Caused Errors):** If *Local Motion Magazine* introduces a major, verifiable typographical error *after* you have explicitly approved a correct proof—such as printing an incorrect phone number, web address, or physical location that severely damages the ad's effectiveness—the publisher will operate in good faith to correct it. At the publisher's discretion, we will provide either a partial refund, a pro-rated credit, or a complimentary "make-good" ad placement in the following month's issue.

7. Cancellations & Refunds | Cancellations must be submitted in writing at least **14 days prior to the artwork deadline** to avoid being billed for that issue. Deposits are strictly non-refundable. If an advertiser cancels after the deposit is paid but before the final balance is settled, or if they fail to meet deadlines, the ad will not run and no refunds or credits will be issued.

8. Editorial Discretion | *Local Motion Magazine* reserves the right to reject, suspend, or request edits to any advertisement or content that does not align with our publication's values, community standards, or aesthetic quality.

9. Publisher Commitments & Circulation Guarantees | **Distribution & Print Minimums:** *Local Motion Magazine* guarantees a minimum combined monthly circulation of 14,000 copies. This includes 12,000 copies direct-mailed directly to single-family households in our designated Boynton Beach delivery zones (ZIP codes 33472, 33473, 33437, 33436) and 2,000 copies distributed via high-traffic local commercial drop-offs (ZIP codes 33426, 33435) .

**Delayed or Canceled Issues:** If a scheduled magazine issue is delayed by more than 30 days or canceled entirely by the publisher due to production or operational disruption, the advertiser's payment for that specific issue will be fully credited toward the next available issue or refunded at the advertiser's choice.

10. "Founder" Pricing & Benefits | By advertising in the inaugural issue of *Local Motion Magazine*, your business is granted lifetime **"Founder" status**, unlocking the following exclusive benefits: **Grandfathered Rates:** You lock in these initial first-issue advertising rates for up to three (3) years from the date of signing, protecting your business from standard rate increases. Following this period, rates may be adjusted by no more than 5% annually solely to account for verifiable increases in print and postage production costs. This rate remains valid as long as the ad size remains the same. Upgrading to a larger ad size in future issues will be subject to then-current market pricing. **No Ongoing Commitments:** You retain total flexibility to run your ad issue-by-issue. You may skip issues and run your ad only in the future issues you choose, completely exempt from any future monthly contract or recurring agreement requirements.

11. Monthly Reader Raffle Rules | *Local Motion Magazine* hosts a monthly $50 Amazon Gift Card drawing to incentivize readers to support our advertisers.  **NO PURCHASE NECESSARY TO ENTER.** Open to local residents aged 18 or older. Void where prohibited by law. Receipts submitted for entry must be clearly dated within the current publication month and from an active *Local Motion Magazine* advertiser. **Alternative Method of Entry:** To enter the drawing without making a purchase, readers may hand-print their name, address, phone number, and email address on a 3x5 index card and mail it to the publisher’s business address. Limit one entry per person per month. Winners are selected via a random monthly drawing.
